TERMS AND CONDITIONS

1. Acceptance of Terms

By accessing, registering, booking, purchasing, investing, participating in, or otherwise engaging with any services provided by Whispering Peaks LLC (“Company,” “Whispering Peaks,” “we,” “us,” or “our”), you (“Client,” “Participant,” “User,” or “Investor”) agree to be legally bound by these Terms & Conditions.

If you do not agree, you must not use our services.


2. Scope of Services

Whispering Peaks provides facilitation, coordination, consulting, and operational services including but not limited to:

  • Tourism packages
  • Cultural & heritage travel
  • Spiritual pilgrimage facilitation
  • Mountaineering & alpine expeditions
  • Skiing & high-altitude programs
  • Trade & export facilitation
  • Investment coordination
  • Digital access & documentation facilitation
  • Logistics and operational support

Whispering Peaks acts primarily as a facilitator and coordinator, not as an insurer, carrier, or direct guarantor of third-party services.


3. Booking & Payment Terms

3.1 All bookings require advance payment as specified in the service agreement.

3.2 Full payment must be received prior to service commencement unless otherwise agreed in writing.

3.3 Payments are considered final once processed.

3.4 The Company reserves the right to cancel bookings if payment is not received in full by the stated deadline.


4. STRICT NO-REFUND POLICY

4.1 All payments are NON-REFUNDABLE unless explicitly stated in a written agreement signed by both parties.

4.2 No refunds shall be issued for:

  • Change of mind
  • Visa rejection
  • Travel delays
  • Personal emergencies
  • Weather conditions
  • Government restrictions
  • Illness
  • Missed flights
  • Dissatisfaction
  • Change in itinerary due to safety or operational needs
  • Inability to participate due to physical condition

4.3 Deposits are non-refundable under all circumstances.

4.4 In the event of force majeure (natural disasters, political unrest, border closures, weather disruptions), services may be rescheduled at Company discretion. No refunds will be issued.

4.5 Investment or trade deposits are non-refundable unless specifically defined otherwise in a separate signed contract.


5. No Returns (Trade & Export)

5.1 All product purchases (including but not limited to gemstones, agricultural goods, herbal products, specialty items) are final sale.

5.2 No returns, exchanges, or refunds are permitted once shipment has been dispatched.

5.3 Risk transfers to the buyer upon handover to the shipping carrier.

5.4 Buyer assumes responsibility for customs clearance, duties, taxes, and import compliance.


6. Assumption of Risk (Adventure & Expedition Services)

Participation in mountaineering, trekking, skiing, high-altitude travel, and remote-region exploration carries inherent risks including but not limited to:

  • Injury
  • Illness
  • Altitude sickness
  • Weather hazards
  • Transportation accidents
  • Natural terrain risks

By participating, you:

  • Acknowledge full understanding of risks
  • Voluntarily assume all personal responsibility
  • Release Whispering Peaks from liability to the maximum extent permitted by law

Travel insurance with evacuation coverage is strongly recommended.


7. Health & Medical Responsibility

7.1 Participants are responsible for their physical fitness and medical suitability.

7.2 Whispering Peaks is not responsible for medical outcomes.

7.3 Clients must disclose relevant medical conditions prior to participation.

7.4 Emergency evacuation costs are the sole responsibility of the participant.


8. Permit & Documentation Disclaimer

8.1 Whispering Peaks may assist in documentation facilitation but does not guarantee approval of:

  • Visas
  • Entry permits
  • Travel permits
  • Investment approvals
  • Trade certifications

8.2 Government decisions are beyond Company control.

8.3 No refund will be issued due to government refusal or delay.


9. Limitation of Liability

To the fullest extent permitted by law:

  • Whispering Peaks shall not be liable for indirect, incidental, consequential, punitive, or special damages.
  • Maximum liability shall not exceed the total amount paid directly to Whispering Peaks for the specific service.

10. Third-Party Providers

We may utilize third-party vendors including:

  • Hotels
  • Transport companies
  • Guides
  • Airlines
  • Government entities
  • Logistics providers

We are not liable for acts, errors, negligence, or omissions of third parties.


11. Force Majeure

Whispering Peaks shall not be liable for failure to perform due to:

  • Natural disasters
  • Political unrest
  • Government actions
  • Pandemics
  • Border closures
  • Security conditions
  • War
  • Strikes
  • Weather disruptions

In such cases, services may be rescheduled at Company discretion.


12. Investment & Financial Risk Disclaimer

12.1 All investments carry risk.

12.2 No guarantees of profit, return, or financial performance are made unless specified in a legally binding investment agreement.

12.3 Whispering Peaks acts as a facilitator and strategic coordinator unless otherwise defined in contract.


13. Intellectual Property

All branding, materials, itineraries, documentation, designs, and digital frameworks remain the property of Whispering Peaks unless otherwise agreed in writing.

Unauthorized reproduction is prohibited.


14. Code of Conduct

Participants must:

  • Follow local laws
  • Respect cultural norms
  • Follow guide instructions
  • Avoid disruptive behavior

The Company reserves the right to terminate participation without refund for misconduct.


15. Privacy & Data Use

Personal information collected may be used for:

  • Booking coordination
  • Operational communication
  • Legal compliance
  • Marketing (unless opted out)

We do not sell personal data.


16. Dispute Resolution

16.1 All disputes shall first be resolved through good faith negotiation.

16.2 If unresolved, disputes shall be submitted to binding arbitration.

16.3 Governing law shall be:

  • Texas law for U.S.-executed contracts.
  • Applicable regional law for in-region operations.


17. Severability


If any provision is deemed invalid, remaining provisions remain enforceable.


18. Entire Agreement

These Terms constitute the entire understanding between the parties regarding services unless superseded by a signed written agreement.


19. Modification of Terms

Whispering Peaks reserves the right to update these Terms at any time without prior notice. Continued use of services constitutes acceptance of updated Terms.



20. Acknowledgment

By proceeding with booking, registration, or investment, you confirm that you:

  • Have read these Terms in full.
  • Understand all risks.
  • Accept the no-refund policy.
  • Agree to be legally bound.
